👨‍👩‍👧 Parental Tool

Story Stars is designed for use by parents and guardians aged 18 and over. The app is not intended for direct use by children. Parents and guardians are responsible for all information entered into the app.

✅ 1. Acceptance of Terms

By accessing or using Story Stars, you confirm that:

• You are at least 18 years of age or the age of majority in your jurisdiction.
• You are the parent, legal guardian, or authorized caregiver of any child for whom you create stories.
• You have read, understood, and agree to be bound by these Terms and Conditions and our Privacy Policy.
• You consent to the use of AI-generated content as described herein.

✨ 2. Service Description

Story Stars is an AI-powered storytelling and lullaby application that generates personalized bedtime stories and lullabies for children.

The Service uses third-party artificial intelligence models, including but not limited to Google Gemini and ElevenLabs for stories and narration, and Suno for lullaby music generation, to create text-based stories, audio narrations, and personalized lullabies based on user-provided inputs including names, ages, locations, and story/music preferences.

🤖 3. AI-Generated Content Disclaimer

IMPORTANT — PLEASE READ CAREFULLY:

• All stories, narrations, and content produced by Story Stars are generated by artificial intelligence and are not reviewed, edited, or approved by a human before delivery.
• While we implement age-appropriate content filters and safety guidelines, AI systems are inherently unpredictable and may occasionally produce content that is inaccurate, inappropriate, nonsensical, or unsuitable for the intended audience.
• We do not guarantee that AI-generated content will be free from errors, inaccuracies, offensive material, culturally insensitive content, frightening themes, or content otherwise unsuitable for children of any specific age.
• AI-generated stories may contain factual inaccuracies, fictional representations of real places, or creative interpretations that do not reflect reality.
• Lullabies are generated by AI music models and are unique each time. The vocals, lyrics, and musical arrangement are AI-composed. Lullaby audio cannot be regenerated identically — each generation produces a new, unique recording.
• You are solely responsible for reviewing any content before sharing it with or presenting it to a child.
• We strongly recommend that a parent or guardian listens to and/or reads each story before or alongside the child.

🛡️ 4. Parental Responsibility

• You acknowledge that you bear full responsibility for determining the suitability of any content generated by the Service for your child or any child in your care.
• You acknowledge that age recommendations and content safety filters are guidelines only and are not a substitute for parental review and judgement.
• You agree to supervise your child's use of the Service at all times.
• You agree to immediately discontinue use if any content is generated that you deem inappropriate, and to report such content to us.

📝 5. User-Provided Information

• You are responsible for the accuracy and appropriateness of all information you provide to the Service, including but not limited to: names, ages, locations, story prompts, and any custom requests.
• You agree not to input prompts, names, or other information intended to circumvent safety filters or generate inappropriate, harmful, illegal, or adult content.
• You represent that you have the right and authority to provide any personal information, including names and locations of children and other individuals, that you input into the Service.
• You agree not to input the personal information of any individual without their consent, or the consent of their parent/guardian in the case of minors.

📍 6. Location Data

• When you provide location information (suburb, city, favourite places), this data is used solely to personalize story content.
• Location data, such as neighborhood, suburb, or city names, is stored locally on your device and is transmitted to Google's servers as part of the story prompt to personalize your child's stories.
• AI-generated descriptions of real-world locations may be inaccurate, fictional, or a blend of real and imagined details. Do not rely on story content for factual information about any location.

🔒 7. Privacy and Data

• Personal information entered into Story Stars, including children's names, ages, and locations, is processed by third-party AI services (Google Gemini, ElevenLabs, and Suno) to generate stories, narrations, and lullabies.
• By using the Service, you consent to the transmission of this data to these third-party providers in accordance with their respective privacy policies and terms of service.
• Story data, chronicles, and user preferences are stored locally on your device. We do not maintain server-side copies of your stories or personal information.
• We do not sell, share, or distribute your personal information or your children's information to any third party for marketing or advertising purposes.
• You may delete all locally stored data at any time by clearing the App's data in your device settings or by uninstalling the App.
• Please note: Because data is stored locally on your device, clearing the App's data, resetting your device, or uninstalling the App may permanently delete your saved stories, preferences, and purchase state. We cannot recover this data.

🧒 8. Children's Privacy (COPPA / GDPR-K Compliance)

• Story Stars is designed for use by parents and guardians, not directly by children.
• We do not knowingly collect personal information directly from children under 13 (or under 16 in applicable jurisdictions).
• All information about children is provided by and with the consent of a parent or legal guardian.
• If you believe a child has provided us with personal information without parental consent, please contact us immediately.

📚 9. Intellectual Property & Content Ownership

• Stories generated through the app are yours to keep and share for personal use. You may enjoy them with your family, share them with friends, and keep them as long as you like.
• You may not commercially reproduce, distribute, sell, or publicly perform AI-generated stories without our prior written consent.
• The Story Stars name, branding, and application design are the intellectual property of MV Developers and are protected by applicable intellectual property laws.
• Lullabies generated through the app use AI music generation technology (Suno). Generated lullabies are created for your personal, non-commercial use. The underlying AI music generation technology is provided under Suno's commercial license terms.

💳 10. Purchases and Payment

One-Time Purchases

• Story Stars offers one-time (non-recurring) purchases, such as individual stories, lullabies, or story chronicle packs, at the prices listed at the time of purchase.
• Payment will be charged to your Apple App Store or Google Play account at confirmation of purchase.
• One-time purchases are non-refundable except as required by applicable law or the policies of the applicable app store (Apple App Store, Google Play Store).
• One-time purchase content is generated on demand and stored locally on your device while in use. Lullabies and stories can be saved to My Stars for later access.

Subscriptions

• Story Stars also offers subscription plans at the prices listed at the time of purchase.
• Payment will be charged to your Apple App Store or Google Play account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your device's Settings > Subscriptions.
• Subscription prices may change with reasonable notice.
• Story generation allowances, including the number of stories available per subscription tier, may be adjusted at our discretion with reasonable notice to subscribers.
• Free trial periods, if offered, will be clearly communicated at the point of sign-up.

General

• All prices are displayed in your local currency as determined by your app store.
• Refunds are handled in accordance with the policies of the applicable app store (Apple App Store, Google Play Store) or payment processor.

⚠️ 11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• Story Stars, its owners, operators, developers, affiliates, and partners (“Released Parties”) shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to:
  • The content, quality, accuracy, or appropriateness of AI-generated stories, narrations, or any other output.
  • Any emotional distress, psychological harm, nightmares, fears, or negative reactions experienced by any child or individual as a result of AI-generated content.
  • Any inaccuracies in the depiction of real-world locations, landmarks, or places.
  • Any technical failures, interruptions, or errors in the Service.
  • Any unauthorized access to or use of your data.
  • Any actions taken based on or in reliance upon AI-generated content.
• The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Our total aggregate liability to you for any and all claims arising from or relating to the use of the Service shall not exceed the amount you paid for the Service in the twelve (12) months preceding the claim.

🧾 12. Indemnification

You agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

• Your use of the Service.
• Your violation of these Terms.
• Content generated based on your inputs.
• Your failure to adequately supervise a child's exposure to AI-generated content.
• Any claim by a third party related to information you provided to the Service.

🔗 13. Third-Party Services

• Story Stars relies on third-party AI services including but not limited to Google (Gemini), ElevenLabs, Suno, and others.
• We are not responsible for the availability, performance, accuracy, or content produced by these third-party services.
• Your use of Story Stars constitutes acceptance of the terms and privacy policies of these third-party providers.
• We reserve the right to change third-party providers at any time without notice.

🚨 14. Content Reporting

• If the Service generates content that you believe is inappropriate, harmful, offensive, or otherwise unsuitable, please report it to us immediately at support@mvdevs.net.
• We take content safety seriously and will investigate all reports.
• We reserve the right to modify our safety filters and content guidelines at any time.

🛠️ 15. Service Availability

• We do not guarantee uninterrupted or error-free operation of the Service.
• We reserve the right to modify, suspend, or discontinue the Service at any time, with or without notice.
• We are not liable for any modification, suspension, or discontinuation of the Service.

🔄 16. Modifications to Terms

• We reserve the right to update or modify these Terms at any time.
• Material changes will be communicated through the App.
• Your continued use of the Service after changes constitutes acceptance of the revised Terms.
• If you do not agree with any changes, you must stop using the Service immediately.

⚖️ 17. Governing Law and Dispute Resolution

• These Terms shall be governed by and construed in accordance with the laws of the State of Victoria, Australia.
• Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.
• Before initiating any legal proceedings, you agree to attempt to resolve any dispute informally by contacting us at management@mvdevs.net.

🇦🇺 18. Australian Consumer Law

If you are an Australian consumer, nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot be excluded, restricted, or modified by agreement.

✂️ 19. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

📘 20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Story Stars regarding the use of the Service, superseding any prior agreements.
